ASHRAEwiki is an online information resource developed by ASHRAE which supports the needs and interests of ASHRAE members and other professionals in the fields of HVAC&R and building technologies in general. The content contained in ASHRAEwiki is for informational, noncommercial use only.

None of the contributors, editors, sponsors, administrators, or anyone else connected with ASHRAEwiki in any way whatsoever, can be responsible for the appearance of inaccurate or libelous information. Nor are they responsible for your use of the information contained in or linked from these Web pages.

There is no agreement or understanding between you and ASHRAEwiki regarding your use or modification of this information. Neither is anyone at ASHRAEwiki responsible should someone change, edit, modify or remove any information that you may post on ASHRAEwiki.

Terms of Use

Acknowledgement and Acceptance

These terms of use govern your use of ASHRAEwiki and all services provided in connection with ASHRAEwiki. If you do not agree to these terms of use, please do not enter ASHRAEwiki.

Please check this document before using ASHRAEwiki to determine whether a change has been made to these terms of use. If you do not agree to any changes in the terms of use as they may occur, please terminate your use of ASHRAEwiki immediately. Your continued use of ASHRAEwiki will signify your acceptance of any change in the terms and conditions set forth herein.

The terms of use comprises the entire agreement between you and ASHRAE and supersedes any prior agreements pertaining to the subject matter contained herein.

Registration and Password

You are responsible for maintaining the confidentiality of your login information, including your username and password, should you choose to create them for ASHRAEwiki commenting purposes. You shall be responsible for all uses of your login information, whether or not authorized by you. You agree to immediately notify ASHRAE of any unauthorized use of your login information.

Use of Registration Data

To register for commenting on ASHRAEwiki, you will need to provide ASHRAE with some personal information such as your name and e-mail address. Use of information collected from users of ASHRAEwiki is governed by the ASHRAE Privacy Policy, which also governs such use regarding the ASHRAE Web site, www.ashrae.org. ASHRAE may amend the information requested from ASHRAEwiki registrants from time to time as the site changes. ASHRAE may allow access to database information by third parties providing technical services, but only to the extent necessary to provide you with those services. In those instances, the third party is bound by these terms and will not be entitled to contact you directly for any reason.

Use of Site

ASHRAEwiki is for your personal use only. Commercial uses of ASHRAEwiki are strictly prohibited unless prior written consent from ASHRAE at wikieditor@ashrae.org has been granted.

You alone are responsible for the content of the information you post on ASHRAEwiki, including any postings or messages made through ASHRAEwiki, and the consequences of any such postings or messages. Any use by you of ASHRAEwiki information, personal or otherwise, for any commercial purpose or to obtain direct financial gain (e.g., mass marketing) is strictly prohibited.

You agree not to post on or use ASHRAEwiki to distribute or send any illegal material of any kind, including but not limited to, illegal material in the form of text, graphics, video, programs or audio. Posting content or participating in any form of discussion with the intention to commit any illegal activity is strictly prohibited. ASHRAEwiki reserves the right to immediately delete any material that it deems meet any criteria outlined above, and to immediately terminate your access, and furthermore to initiate efforts to block you from further use of ASHRAEwiki. ASHRAE will cooperate fully with any law enforcement officials and/or agencies in the investigation of any person or persons who violate the terms of service.

You further agree to abide by all applicable local, state, national, and international laws and regulations in your use of ASHRAEwiki, and agree not to interfere with the use and enjoyment of ASHRAEwiki by others.

Applicable Law

The terms of use shall be governed by and construed in accordance with the laws of the state of Georgia, except with regard to its conflicts of law rules. Each party irrevocably consents to the exclusive jurisdiction of the courts of the state of Georgia and the federal courts situated in the state of Georgia in connection with any action arising under the terms of use or relating to ASHRAEwiki. Any cause of action brought by you or your authorized user(s) with respect to ASHRAEwiki must be commenced within one (1) year after the claim or cause of action arose or it will be barred.

Copyright and Trademarks

The contents of ASHRAEwiki are protected by copyright. Unauthorized use of this material may violate copyright, trademark, and other laws.

Any material, information or other communication you transmit or post to ASHRAEwiki will be considered nonconfidential and nonproprietary (‘communications’). ASHRAE will have no obligations with respect to the communications. ASHRAE and its designees will be free to copy, disclose, distribute, incorporate, and otherwise use the communications and all data, images, sounds, text, and other things embodied therein for any and all commercial or non-commercial purposes without attribution to you, and ASHRAE will be free to use in other works that are published or copyrighted by ASHRAE information you transmit or post to ASHRAEwiki.

You acknowledge that ASHRAEwiki contains information, software, photos, video, graphics, sound or other materials (collectively, ‘content’) that are protected by copyrights, trademarks, trade secrets or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed.

Discussion includes any place where a site visitor or member can interact with ASHRAEwiki and submit content or questions to the site. This includes discussion boards, comments, e-mail or other functions offered as part of ASHRAEwiki (the site). If you participate in any Discussion on the site, you must not:

ASHRAE shall not be liable for any statement, misstatement, inaccuracy, or omission of any type for any content submitted by a site member or visitor on any Discussion.

ASHRAE may remove or edit any content posted to any Discussion at any time and for any reason. By submitting or uploading any materials to any Discussion, you represent and warrant that you are the owner of such materials and by that action grant ASHRAE a perpetual, royalty-free, irrevocable, nonexclusive right and license to use and reproduce any such material for display on the site or a derivative created from the site.

ASHRAE does not intend to quash the free flow of ideas and opinions about HVAC&R and building technology in general, but absolutely insists that all such information be sound, and offered in a professional and courteous manner.

Privacy Policy

It is ASHRAE’s policy to keep personal information collected at ASHRAEwiki confidential, and to not sell, rent, loan, or otherwise disclose such information to third parties, except as described in this Privacy Policy, unless permission is obtained from the user or as required by a lawful court order or subpoena. Use of member contact information by volunteers conducting ASHRAE activities, under the safeguards outlined herein, is not considered third-party use.

ASHRAE may be required to provide personal information about any of its users to law enforcement or government agencies if requested and/or as we deem necessary.

ASHRAE seeks to use commercially reasonable managerial and technical precautions to help protect the security and integrity of the personal information collected directly by ASHRAE or through the Internet. Regardless of the precautions taken by you or by ASHRAE, 'perfect security' does not exist at ASHRAE or on the Internet. ASHRAE cannot ensure or warrant the security of any information you transmit directly to ASHRAE or from ASHRAEwiki, hence you transmit such information at your own risk.

ASHRAEwiki may include links to the sites of ASHRAE’s business partners, sponsors, advertisers, or others. ASHRAE is not responsible for the content or the security and privacy policies of these other sites, which may be different from ASHRAE’s security and privacy practices.

ASHRAE analyzes the ASHRAEwiki site logs to continually improve the value of the content and services available on the site. In general, ASHRAEwiki automatically gathers certain usage information, like the number and frequency of visitors to ASHRAEwiki and to particular portions of the site. ASHRAEwiki site logs are not personally identifiable, and we do not attempt to link them with the individuals who actually browse the site.

As you click through the pages on ASHRAEwiki, our server logs information about your session on the site. This includes such information as the site address from which you came, the browser you are using, the country from which you are accessing the Internet, the time and date of your visit, how long your session lasted, what pages you visited, and your Internet Provider (IP) address. We do not log IP addresses to track your session, nor do we link IP addresses to any personally identifiable information.

We store all personal information on our secure server. It is ASHRAE’s policy not to reveal any personal information to any third party without the owner's permission with the exception of, but not limited to, the following:

  •   When in the execution of ASHRAE-sanctioned activities, and third parties are acting on ASHRAE’s behalf.
  •   ASHRAE may provide or transfer personal information to one or more third parties in the event of a “Change of Control Event”, meaning that all or part of ASHRAE, or all or part of the assets of ASHRAE, are acquired by, merged with, sold to, or otherwise disposed of to one or more third parties (including, without limitation, in the event of bankruptcy).

A cookie is a piece of data stored on the user's hard drive that contains information about the user. ASHRAE reserves the right to use cookies on ASHRAEwiki. Usage of a cookie is not linked to any personally identifiable information while the user is visiting our site. This information is used to assist ASHRAE in creating a site that will serve the needs of users.
